In Pennsylvania, every citizen has the right to file a private criminal complaint pursuant to PA Criminal Rule 506 before a district justice, similar to the authority held by a police officer. Mr. Dunbar exercised this right when he detected corruption in the Pennsylvania court processes. His complaints targeted several judges and prosecutors, aiming to bring transparency and accountability to the system.
Facing Retaliation for Seeking Justice
However, Dunbar’s efforts to expose corruption were met with swift and severe retaliation. After filing his complaints, he was charged with the rare crime of barratry—vexatious litigation—due to his numerous filings over the years. Despite being arraigned and handed a hefty $50,000 bail, it was clear that these charges were a form of prosecutorial retaliation against Dunbar for utilizing his right to due process and access to the courts.
Overcoming Legal and Institutional Obstacles
Dunbar’s challenges did not end there. The Pennsylvania Department of Corrections posed further obstacles when he tried to file his private criminal complaints. Initially, the charges of barratry and retaliation were dismissed by the district justice, but the prosecution did not relent. Instead of accepting the dismissal, they refiled the charges before the President Judge, bypassing an independent jurisdiction and raising serious concerns about the fairness of the process.
