CONDITIONAL PARDON (PART 7), by David Bomber

V. ADULT & JUVENILE CRIMINAL HISTORY

In accordance with the Virginia Pardon Petitioner Questionnaire, the Petitioner has enclosed the Criminal History Attachment compiled by probation officer Andrew J. Martin (Ex. 24). Additionally, the Petitioner has also enclosed the Virginia State Police Criminal History Report (Ex. 25).

To summarize the Petitioner’s past criminal history, the Petitioner essentially began a downward spiral beginning when his parents ejected him from the household on his eighteenth birthday in 1991. Having no permanent place to live, the Petitioner found it extremely difficult to maintain employment – so the Petitioner turned to crime. At the same time the Petitioner also began making a multitude of other very poor decisions, including indulging in marijuana, cocaine, and abusing alcohol. As evident from the Petitioner’s criminal history, this vicious cycle continued for a number of years.

As previously mentioned, the Petitioner now recognizes that these past negative behaviors and patterns have contributed to his criminal history, and as a result the Petitioner has diligently been making strides to break this cycle.

VI. COMMUNITY SUPPORT & RELEASE PLAN

Enclosed are the following items for additional consideration:

Letter from Malissa Hartwell (Ex. 26), whom was a Commonwealth witness concerning the aggravated malicious wounding and second-degree murder indictments.

See also affidavit from Malissa Hartwell (Ex. 27)(describing how distraught and remorseful the Petitioner was immediately following the stabbing.

Upon his release, the Petitioner plans on residing out of state with his childhood friend, whom he has known since 1989. See letter from Walter Fizer (Ex. 28).

VII. CONCLUSION

For the foregoing reasons the Petitioner prays that the Governor of Virginia grants the Petitioner a conditional pardon and affords him the following relief:

1. Vacate the Petitioner’s sentence of 25 years for aggravated malicious
wounding, or;

2. Reduce the Petitioner’s sentence to such as it falls within the
recommended sentencing guidelines, or;

3. Modify the Petitioner’s sentence as the Governor deems just and
proper.
