III. POST-CONVICTION APPEALS

The Petitioner was formally sentenced on November 8th, 2011 in the Roanoke County Circuit Court. Following that the Petitioner presented an appeal to the Court of Appeals of Virginia and on June 11th, 2012 his petition for appeal was denied (Ex. 7).

The Petitioner appealed to a three judge panel with the Court of Appeals of Virginia and on August 1st, 2012 his petition was granted in part (Ex.8). However, on March 5th, 2013 the Court of Appeals of Virginia denied the Petitioner’s appeal (Ex. 9).

The Petitioner then submitted an appeal to the Virginia Supreme Court and on October 2nd, 2013 his appeal was granted in part (Ex. 10). However, on February 27th, 2014 the Virginia Supreme Court denied the Petitioner’s appeal (Ex. 11).

On April 25th, 2014 the Virginia Supreme Court denied the Petitioner’s petition for a rehearing (Ex. 12) and on May 22nd, 2014 the Court issued its mandate (Ex. 13).

Although the Petitioner appealed to the United States Supreme Court his petition for writ of certiorari was denied on October 6th, 2014. Following that the Petitioner filed petitions for a writ of habeas corpus with both the state and federal courts. Subsequently, the United States Supreme Court denied his petition on January 8th, 2018 (Ex. 14).

Additionally, being that the Petitioner asserted self-defense in the aggravated malicious wounding and second-degree murder indictments, the Petitioner does not intend to file a Petition for Writ of Actual Innocence with the Attorney General’s office concerning these two convictions.

However, the Petitioner is simultaneously filing a Petition for Writ of Actual Innocence with the Attorney General’s office concerning the three assault & battery indictments.

IV. CHARACTER OF PETITIONER

a. EMPLOYMENT HISTORY

(2007-2008) – The Petitioner worked as an electrician’s helper at G.J.
Hopkins in Roanoke, Va.

(2008-2010) – The Petitioner worked as an electrician at Gillman Services
in Roanoke, Va.

(2009-2010) – The Petitioner moonlighted as a server at Ryans
Steakhouse in Christiansburg, Va.

(2013-2018) – The Petitioner who is currently incarcerated within the
Virginia Dept. of Corrections was employed in the kitchen at
Nottoway Correctional Center.

(2018-2019) – The Petitioner who is currently incarcerated within the
Virginia Dept. of Corrections was employed as a pod
sanitation worker at Nottoway Correctional Center.

(Mar. 2019) – Currently, the Petitioner who is incarcerated within the
Virginia Dept. of Corrections has maintained employment
with Virginia Correctional Enterprises in the woodshop at
Nottoway Correctional Center since March 4th, 2019
(Ex. 15).

b. EDUCATIONAL ACCOMPLISHMENTS

The Petitioner obtained his G.E.D. in 1993 at the Southampton Intensive Training Center (S.I.T.C. Boot Camp).

The Petitioner attended Virginia Western Community College in Roanoke, Va. in the fall of 2004, majoring in Information Systems Technology.

The Petitioner attended Virginia Western Community College in Roanoke, Va. in the summer and fall of 2009, majoring in electrical studies (Ex. 16).

The Petitioner is expecting to take college courses in General Studies that are being offered by Southwest Virginia Community College at Nottoway Correctional Center (Ex. 4).

c. PROGRAMS/CERTIFICATES

The Petitioner obtained a certificate on May 22nd, 2014 for a Bible Correspondence Course from the Source of Light Ministries (Ex. 17).

The Petitioner obtained a certificate on November 15th, 2015 from the Kairos Inside Weekend Program (Ex. 18).

The Petitioner obtained a ServSafe Certification at Nottoway Correctional Center on June 24th, 2016 (Ex. 19).

The Petitioner obtained a certificate on October 16th, 2016 from the American Bible Academy (Ex. 20).

The Petitioner obtained a certificate of baptism at Nottoway Correctional Center on June 29th, 2017 (Ex. 21).

The Petitioner is currently on the waiting list to attend the Victim Impact Group (Ex. 22).

The Petitioner is currently on the waiting list to attend the Economic & Personal Finance class (Ex. 23).

The Petitioner is currently on the waiting list to take Thinking For A Change (Ex. 3).

The Petitioner is currently on the waiting list to attend the Anger Management and Substance Abuse classes.

d. ANNUAL REVIEW

As indicated in the Institutional Classification Authority Hearing reports, the Petitioner has exhibited exceptional behavioral and institutional adjustment by remaining infraction free and maintaining steady employment (Ex. 3). Further, he intends to fulfill his treatment needs as determined by his counselor by attending Thinking For A Change when placement becomes available.

Although it isn’t part of the Petitioner’s treatment needs as determined by his counselor, the Petitioner nonetheless intends to attend the Anger Management and Substance Abuse classes, and is currently on the waiting list for both.
