I NEED YOUR HELP IN SUPPORT OF MY CAUSE by David Bomber

Hello there. If you would be so kind as to allow me a few moments of your time so that I may explain to you why your help is so desperately needed.

As of July 13th, 2011, I was the very first person in Virginia to be convicted of both aggravated malicious wounding and second-degree murder of the same victim. What is so interesting about that is I only stabbed the victim ONCE. It is a fact that I do not deny and further continually assert was only done out of necessity following an attack that occurred inside of my apartment by someone that I had just met that same day.

Although I asserted self defense, the jury nonetheless found me guilty. In which case I found myself submitting various appeals, with the assistance of court appointed counsel of course. As this was going on, I thought that surely both the Court of Appeals and the Supreme Court of Virginia would side with me on the Double Jeopardy issue. Much to my shock and disappointment, both courts decided that my convictions were valid since the Virginia’s legislature didn’t define the law as to whether or not they intended multiple punishments for a single offense under either statue.

After unsuccessfully exhausting both the appellate process and what civil remedies I had available, I decided to try a different course of action and present a petition to the Virginia General Assembly in order for a bill to be introduced during the 2019 session. My goal is to amend the statue on aggravated malicious wounding so in a scenario such as mine a person will not be punished cumatively. In other words, either they will face trial for some sort of malicious wounding or murder, but not both in instances where a single victim is involved. As much as I do not like the second-degree murder conviction, I don’t have much choice at this point but to take the high road and accept that particular conviction. However, in that same breath, I am taking the opportunity to be the catalyst for future defendants so that they are not subjected to multiple punishments such as mine in Virginia. Hopefully, it will curb some of the unfair practices employed by overzealous prosecutors.

Although I have put in the leg work as far as forwarding a petition to one of the delegates in the Virginia General Assembly, I still lack a necessary component – an attorney to act not only as a liaison with the Virginia General Assembly but also an advocate in this endeavor. Since I cannot afford to retain counsel, I am asking for whatever contributions that you may be able to provide to assist me in my pursuit of justice.
